Acceptance of Terms
By downloading, installing, or using the Forchetta app ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legal agreement between you and Peter Pinti ("we," "us," or "our"), the operator of Forchetta.
You must be at least 13 years old to use Forchetta. By using the App, you confirm that you meet this requirement.
Description of Service
Forchetta is a social restaurant discovery app that allows users to:
- Save and organise restaurants into custom lists
- Share restaurant recommendations with friends
- Discover restaurants saved by people they follow
- Rate and review restaurants they have visited
- View restaurant locations on an interactive map
- Comment on and react to friends' restaurant saves
We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.
Accounts & Registration
To use Forchetta, you must create an account. You agree to:
- Provide accurate and complete information when creating your account
- Maintain the security of your password and account credentials
- Notify us immediately of any unauthorised use of your account
- Take responsibility for all activity that occurs under your account
- Not create more than one account per person
- Not create an account on behalf of someone else without their permission
You may sign in using Apple ID or Google Sign-In. By doing so, you authorise us to access certain information from those services as described in our Privacy Policy.
User Conduct
You agree not to use Forchetta to:
- Post false, misleading, or inaccurate restaurant information
- Harass, abuse, or harm other users
- Post spam, advertising, or promotional content without permission
- Impersonate any person or entity
- Violate any applicable laws or regulations
- Attempt to gain unauthorised access to other users' accounts or our systems
- Scrape, crawl, or use automated tools to access the service
- Post content that is illegal, offensive, or violates third-party rights
We reserve the right to remove content and suspend or terminate accounts that violate these rules.
User Content
Your Content
You retain ownership of content you create on Forchetta, including your restaurant saves, notes, ratings, comments, and profile information ("User Content").
By posting User Content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your content solely for the purpose of operating and improving Forchetta.
Content Standards
Your User Content must not:
- Be false, defamatory, or misleading about any restaurant or person
- Infringe any third-party intellectual property rights
- Contain personal information about others without their consent
- Be obscene, offensive, or otherwise inappropriate
Content Removal
We may remove User Content that violates these Terms or that we determine, in our sole discretion, is harmful to users or the service. You may delete your own content at any time.
Intellectual Property
The Forchetta app, including its design, logo, branding, and software, is owned by Peter Pinti and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on Forchetta without our express written permission.
Restaurant data is sourced from Google Places API and is subject to Google's terms of service. Restaurant names, logos, and trademarks belong to their respective owners.
Privacy
Your use of Forchetta is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using Forchetta, you consent to the collection and use of your information as described in our Privacy Policy.
Third-Party Services
Forchetta integrates with third-party services including Google Places, Resy, OpenTable, DoorDash, and others. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the content, practices, or policies of third-party services.
Affiliate links to booking and delivery services are clearly labeled. We may earn a commission when you make a reservation or order through these links, at no additional cost to you.
Disclaimers
Forchetta is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
- The service will be uninterrupted or error-free
- Restaurant information will be accurate or up to date
- The service will meet your specific requirements
- Any errors in the service will be corrected
Restaurant information is sourced from Google Places API and user contributions. We are not responsible for the accuracy of restaurant details, hours, or availability.
Limitation of Liability
To the fullest extent permitted by law, Peter Pinti shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Forchetta, including but not limited to loss of data, loss of revenue, or personal injury.
Our total liability to you for any claims arising from these Terms or your use of Forchetta shall not exceed the amount you paid us in the 12 months preceding the claim.
Termination
You may delete your account at any time from the Profile screen in the app. Upon deletion, your data will be removed in accordance with our Privacy Policy.
We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. We will provide reasonable notice where possible.
Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes via the app or email. Your continued use of Forchetta after changes are posted constitutes your acceptance of the updated Terms.
